I require a $50.00 retainer (non-refundable) to secure your date along with this contract completed to book your child's session, please be sure to send the deposit via EMT to julie@julieceraphotography.com and note the name of who booked the session in the comment box. Auto deposit is enabled so no question or password is required. When opening the invoice after you sign the contract it will prompt you to "pay now", please click that button and then pick "payment #1" and the click the "pay later" button. You will then open the payment instructions (same as the instructions above) and you may the close the document. Upon receiving the contract and the deposit I will go ahead and book the session in my system and email you the confirmation. My address will be attached to that email. I will also send you a confirmation of payment of your deposit when it is received which will also show the remaining balance due on the date of the session. The session guide will also be attached to your booking confirmation email, I highly recommend looking it over in order to have a successful session for your little one! Your Session will include: · Photographer’s time and talent · 20-minute session · Use of all 3 Christmas set's within your booked time · 8 digital hi-resolution edited images included · Online proofing gallery · Extra images at a discounted rate at $15.00 per image Price: $175.00 plus HST ($50.00 non-refundable retainer required and will be put towards your session) I require a $50.00 retainer (non-refundable) to secure your date along with this contract complete to secure and book your date and time, please be sure to send the via E-TRANSFER to julie@julieceraphotography.com. The client has 24 hours to return the contract along with the deposit, if the contract and deposit is not sent in within 24 hours Julie Cera Photography reserves the right to give your booking date and time away to another client without notice. The contract and appointment is also not finalized until the document is signed and the retainer is paid. The deposit will be deducted from your session fee upon session completion and payment. The deposit is non-refundable. If a situation arises where baby cannot be settled during the entire session after several attempts and the session needs to end or the session time has run out (and not enough images where able to be taken) the deposit is still non-refundable, but the remainder of the session fee does not need to be paid. The balance of the session is due on the date of the session via EMT, Julie Cera Photography will not be working on your proofs/gallery until the balance is paid in full – no exceptions. If client fails to make the final payment the deposit and the images are withheld indefinitely until the full payment is made. If the client refuses to make the balance payment the images and gallery will be purged and deleted completely (this cannot be reversed). In the case extra edits are purchased they will not be released and sent until the invoice for the extra edits has been paid in full. RAW/Proof images will not be sold, there are no exceptions – RAW/Proof images are not a true representation of my brand, I only provide finished artwork only. Your proofs (watermarked images) and final edits only can all be downloaded with a PIN once the final edits are ready. Your final edited images will have NO watermarks. Images without watermarks must be purchased. Extra image packages are optional and are additional to your session package. You will be invoiced separately for extra images and the invoice must be paid in full before you are granted access to download your extra final images. Extra edit packages are as follows: 1 extra image - $15 plus HST 10 extra images - $100 plus HST 20 extra images - $200 plus HST 30 extra images - $300 plus HST It is the client’s responsibility to be on time for the scheduled session, in most cases Julie Cera Photography will not be able to make up for the lost time hence your session will be cut short or will need to be cancelled due to lack of time (the deposit will be withheld and cannot be used against a rescheduled session). Julie Cera Photography reserves the right to cancel your session and keep your deposit if you are over 5 minutes late for your session at the discretion of Julie Cera Photography. I am able to go over the allotted time with Christmas Mini's as other families are scheduled after your reserved time. The deposit is non-refundable as there is a high possibility I will not be able to fill in your spot in time, if enough notice is given and I am able to fill your spot I will be happy to refund your deposit. Exception made if due to extreme weather out of our control, acts of God, natural disaster, a pandemic, or serious illness that could prevent your child from having a successful session. Julie Cera Photography cannot guarantee specific poses for your baby and is also not responsible if your baby or children are uncooperative during the session. Julie Cera Photography has the right to refuse a certain pose or use of a prop which is unsafe to your child. Julie Cera Photography’s goal is to provide your proofs to you within 3 weeks of the session date (proofs will have minimal retouching), however at times it may be possible that the proofs are delayed due to higher workflow and busy seasons or other obligations. Proofs will be presented to you via an online viewing gallery, and you are responsible for selecting and sending your selections back to Julie Cera Photography. The quantity of proofs you will receive is not guaranteed and will depend on the time and cooperation during your session. The images presented to you will only be of the quality that Julie Cera Photography approves, therefore if a situation occurs that is out of my control (children/family members not cooperating, someone in the session falls ill, baby does not sleep, etc.), you will be provided with the best images that were taken during the session. Only the final approved images by you will have general touch ups without watermarks (i.e., hair strands, fur hairs from my props, small skin imperfections such as pimples and/or technical errors, lighting touch up’s, skin color corrections), to the standards of Julie Cera Photography. Editing which exceeds the editing processes of Julie Cera Photography standards will be charged out at $50/per hour by my myself or a third-party editor (such as face/head swaps/body part swaps, complete background changes, severe acne, belly button clips (newborns), severe stretch marks, tattoos, large birthmarks, tan lines, body hair, double chin, tummy tucks, baby wrinkles/rolls or any other editing which exceeds the editing process deemed by Julie Cera Photography). You the client have a total of 4 weeks from the delivery date of your gallery to select your favorite images for editing if you have not done so I will need to remove your images from the gallery to archive. Once archived there will be a $50 plus HST fee to unarchive your images and put them back in the gallery. Once you have submitted your final images for editing the final edits will be completed within 2 weeks. Once the final edits are delivered to you the online gallery will stay open for 2 weeks from the date, I have sent them to you, you have 2 weeks to process all your downloads and back up your images. Once the 2 weeks have expired, they will be archived and removed. In the case you did NOT download your images within the 2 weeks and the images have been archived there will be a $50 plus HST fee to unarchive your images. Julie Cera Photography will backup/archive the clients final edits and proofs only (no RAW images will be backed up and saved) for up to 1 year following the date the gallery was finalized and images were sent for downloading. It is your responsibility to back up your files to ensure your images are not lost (i.e., USB drive, CD, backup drive, iCloud etc.) Julie Cera Photography cannot guarantee your images will be available to unarchive after 1 year. Once the 1 year has passed Julie Cera Photography will purge and delete all images and they will no longer be able to be recovered. Julie Cera Photography is not responsible for any falls or accidents while in the studio or on the premises, or on site at any other shoot location, and for choking or rashes (for sessions involving food). It is always the responsibility of the parent or caregiver to ensure their own safety and the safety of the child. I understand that Julie Cera Photography accepts no liability for any injury taking place during any photo session or while visiting the premises for any reason. The client agrees to indemnify and hold harmless Julie Cera Photography for any liability, damage, or loss related to technological failure. Cameras, hard drives, and memory cards are subject to technical failure. Julie Cera Photography will take reasonable steps to prevent data loss, but is not liable for loss of data due to technical failure. Client understands and agrees that Julie Cera Photography may have cords, light stands, tripods, backgrounds, camera bags and other gear at the studio or location. Client will hold Julie Cera Photography harmless for any damage, personal injury, or loss caused by tripping over or otherwise being injured from this equipment. The client further agrees to hold the photographer harmless for any personal injury which may occur as the client poses or works with Julie Cera Photography. Any images posted online (behind the scenes etc.) which were taken at my studio, must be credited back to Julie Cera Photography either by tagging the social media page associated with your post (Instagram - @julieceraphoto or Facebook – Julie Cera Photography), providing the website address (www.julieceraphotography.com) or by providing the full name of the studio (Julie Cera Photography). Any images taken by Julie Cera Photography and posted on social media must not have any filters applied to them (as noted in the print release below). Julie Cera Photography is committed to providing a safe and inclusive environment for the wellbeing of all visitors and clients. Julie Cera Photography practices health and safety protocols in the studio or at any shooting location by regularly cleaning between appointments and disinfecting all surfaces, fabrics, and props. The client understands and acknowledges that health and safety is the responsibility of Julie Cera Photography and everyone who visits the studio or any other shooting location. The client will provide accurate and truthful information regarding their family's health and will advise if you or your child attending is ill or has any symptoms of illness. The client willingly attends scheduled appointments and releases Julie Cera Photography from any liabilities from illness following scheduled sessions. Julie Cera Photography reserves the right to refuse a client where health and safety is a concern. PRINT RELEASE I, Julie Cera, of Julie Cera Photography, is the rightful owner of these digital images. I authorize the client permission to print these digital images. Original copyright remains with the photographer. The photos may be printed but not altered or edited in any way other than by the photographer and alterations of any kind is a violation of the copyright. This includes applying filters of any kind. Julie Cera Photography is not liable for print quality, cropping or coloring of any photos not printed directly through my professional lab. Photo quality is only guaranteed through photos purchased directly through me and my lab. Proper recognition of Julie Cera Photography is appreciated and mandatory when publishing photos and using them online (example-when posting them on Facebook, Instagram, or Twitter). Photos may not be entered in any contest or provided to vendors for use without my prior consent and without proper credit to Julie Cera Photography. MODEL RELEASE In consideration of my engagement as a model (Participant), upon the terms stated below, I hereby give to Julie Cera Photography., Julie Cera, the following authority and permission: a) The unrestricted right and permission forever to copyright and use, reuse, publish, and republish photographic portraits or pictures of me or in which I may be included intact or in part, composite or altered, without restriction as to changes or transformations in conjunction with my own or a fictitious name, made through any and all media now or hereafter known for illustration, art, promotion, advertising, trade, or any other purpose whatsoever. b) I also permit the use of any text material in connection therewith. c) I hereby relinquish any right that I may have to examine or approve the completed product or products or the advertising copy or printed matter that may be used with these photographs. d) I hereby affirm that I am over the age of majority and have the right to contract in my own name. I have read the above authorization, release, and agreement, prior to its execution; I fully understand the contents thereof. This agreement shall be binding upon me and my heirs, legal representatives, and assigns. I am also aware that these terms are subject to negotiation, deletion, or addendum, which may be valid if handwritten on this release and initialed and dated by both parties (The Photographer and Undersigned).
